Patrick Marleau's testimony in John Tavares' tax case could change how Canadian NHL teams sign stars

Patrick Marleau took the stand this week in the Tax Court of Canada, and what he told the judge could matter to every team north of the border.

Marleau, testifying as a witness for former teammate John Tavares, said Toronto has leaned on its signing bonus structure as a tool to convince top free agents to choose the Maple Leafs over lower tax jurisdictions in the United States.

That admission sits right at the center of an $8 million dispute that started with one man's contract and is quickly becoming a question for the entire league.

The case traces back to July 2018, when Tavares signed his seven year, $77 million deal to leave the New York Islanders for his hometown team.

Of that contract, $15.25 million arrived as a signing bonus in year one.

The CRA wants to tax that chunk as ordinary salary, north of 50 percent.

Tavares argues it should fall under the Canada U.S. tax treaty as an inducement, taxed at 15 percent, a rate he says he already paid.

Marleau isn't just a witness here.

He signed his own three year, $18.75 million contract with Toronto in 2017, with $14.5 million structured as a signing bonus.

He's fighting a similar reassessment tied to roughly $3.8 million in disputed taxes from that deal.

If the CRA wins, Canadian teams lose a key recruiting tool against tax friendly American markets.

If the players win, expect signing bonuses to become the standard playbook for every Canadian franchise chasing elite free agents.

The trial continues for two more weeks, with a ruling expected to shape contract talks across the league.
